HIPAA in General

Artificial Intelligence (AI) is transforming healthcare by enabling faster diagnosis, more accurate triage, remote patient monitoring, and advanced predictive analytics. However, when these systems access, process, or generate PHI on behalf of covered entities or business associates, their operators fall under HIPAA’s scope and must ensure compliance. - Algorithmic Transparency: ‘Black box’ AI models can create tension with HIPAA’s patient right of access to their own PHI. While HIPAA does not require disclosure of model logic, organizations should ensure that patients can access their underlying health information and, where appropriate, provide understandable explanations of how it was used in decision-making.
- Third-Party Vendor Risk: A compliant hospital can still be exposed if its AI vendor fails to implement HIPAA safeguards.

- Privacy by Design: Integrate HIPAA safeguards during the design phase of AI systems, not as an afterthought.
- Data Minimization: Limit PHI collection and use to the absolute minimum necessary for clinical functionality.

- Explainability and Transparency: Provide clinicians and patients with interpretable outputs and, where possible, rationales behind AI-driven decisions.
- Auditability: Maintain detailed audit logs of model training datasets, access events, and inference results for compliance reviews.
- Encryption and Secure Storage: Apply encryption to PHI at rest and in transit, including training datasets and outputs.
- Independent Testing: Validate AI models for bias, accuracy, and reliability before deployment in clinical environments.
Future Developments in HIPAA and AI
Regulators recognize that HIPAA was originally enacted in 1996, long before AI and modern telehealth. As a result, updates are being considered to address:
- Clearer standards for algorithmic explainability and patient access to model logic
- Rules for adaptive and real-time learning models in clinical workflows
- Guidance on cross-border data sharing and cloud-hosted PHI
- Integration with federal initiatives like the NIST AI Risk Management Framework and FDA’s AI/ML SaMD guidance
