PIPEDA & AI in Healthcare: Overview
The Personal Information Protection and Electronic Documents Act (PIPEDA) is Canada’s federal private-sector privacy law (S.C. 2000, c. 5).
It governs how organizations collect, use, and disclose personal information in the course of commercial activities — including
AI-enabled healthcare services such as virtual care, remote monitoring, decision support, and patient engagement tools.
PIPEDA remains the baseline across Canada, except where a province has enacted “substantially similar” legislation.

Enacted in 2000, PIPEDA modernized Canadian privacy rules for e-commerce and private-sector data handling.
It applies nationally to commercial activities involving personal information, with exceptions where provinces have
substantially similar laws (e.g., Ontario’s PHIPA for health information, Alberta’s HIA).

Why It Matters for AI in Healthcare
AI in healthcare increasingly touches personal — and sometimes highly sensitive — information, such as identifiers, clinical readings,
biometrics, behavioral data, and device telemetry. If your AI system collects, uses, or discloses such personal information in a
commercial context, PIPEDA obligations apply.

10 Fair Information Principles outlined by the OPC:
- 1. Accountability — Appoint a privacy officer, implement policies, monitor vendors.
- 2. Identifying Purposes — Clearly explain why data is collected (training, inference, QA, fraud detection, etc.).
- 3. Consent — Obtain meaningful consent; adapt for context and sensitivity.

- 5. Limiting Use, Disclosure, and Retention — Use data only for identified purposes; define retention & deletion milestones.

- 7. Safeguards — Match protections to sensitivity: encryption, access control, logging, secure MLOps, adversarial testing.
- 8. Openness — Publish clear policies and model-level notices users can understand.
- 9. Individual Access — Provide access and correction mechanisms for personal information.

AI-Specific Considerations Under PIPEDA
- Valid, informed consent — Disclose AI uses (training, inference, human-in-the-loop), categories of data, profiling impacts, and meaningful options.

Grey Zones, Gaps & Emerging Reforms
PIPEDA does not explicitly regulate AI models or algorithmic profiling. Questions persist around automated risk scoring,
bias in diagnostic algorithms, explainability standards, and the treatment of de-identified data that could be re-identified.
Canada has proposed major reforms via the Digital Charter Implementation Act (Bill C-27), which would enact:
